These Terms of Service (the “Terms”) are an agreement between you and Yeeerp (“Yeeerp,” “we,” “us” or “our”). They govern your access to and use of our websites, applications and related services (the “Services”), which provide an online directory and marketplace for licensed cannabis retailers, delivery services, brands and products.
By accessing the Services, creating an account, or clicking to accept these Terms, you agree to be bound by them and by our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 21 years old to use the Services, or at least 18 and a qualifying medical cannabis patient in a state whose law permits it. You must also be located in a jurisdiction where the activity you are undertaking is legal.
We ask you to confirm your age before entering the site, and we may require government-issued photo identification — and, where necessary, a selfie matched against it — before you can place an order or use certain features. You agree that the information you give us for this purpose is true and belongs to you. Providing false age or identity information, or using someone else’s identification, is a material breach of these Terms and will result in your account being closed.
Cannabis remains illegal under United States federal law and under the law of some states. Nothing in the Services is an invitation to break any law that applies to you, and it is your responsibility to know the rules of your own jurisdiction.
When using the Services, you agree not to:
The Services let you post reviews, ratings, comments, photographs, community posts and other material (“User Content”). You keep ownership of your User Content.
By posting User Content, you grant Yeeerp a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, modify for formatting, publish, publicly display, distribute and otherwise use that content in connection with operating, promoting and improving the Services. This licence lasts for as long as your content is on the Services and for a reasonable period afterwards to allow for backups and cached copies.
You represent that, for any User Content you post:
We do not pre-screen User Content and are not obliged to. We may, however, remove or refuse content that breaches these Terms or that we reasonably consider harmful, and we may do so without notice. If you believe content on the Services infringes your copyright, contact us at legal@yeeerp.com with the details required by the Digital Millennium Copyright Act.
The Services include listings for dispensaries, delivery services, brands, products and events. Listing information may come from the business itself, from public records, from licensing authorities or from our own research, and it changes constantly. We do not guarantee that any listing — including menus, pricing, stock, hours, licence status or delivery coverage — is complete, current or accurate.
If you claim or manage a listing, you additionally agree that:
A listing on the Services is not an endorsement, certification or recommendation by Yeeerp.
Yeeerp is not a cannabis retailer, dispensary or delivery service, and we do not sell, possess, transport or deliver cannabis products. When you place an order through the Services, you are ordering from the independent, licensed business shown on the listing. That retailer — not Yeeerp — is the seller and is solely responsible for:
Prices and availability shown on the Services are supplied by retailers and may be out of date or incorrect; the price confirmed by the retailer at fulfilment governs. A retailer may refuse or cancel an order, including where they cannot verify your age or where the product is no longer in stock. Questions about a specific order should go to the retailer first. We will help where we can, but we are not a party to the sale.
Content on the Services — including strain descriptions, product information, articles and user reviews — is provided for general information only. It is not medical advice, and it is not a substitute for consultation with a qualified healthcare professional. Never disregard professional medical advice, or delay seeking it, because of something you read on the Services.
The Services, and everything in them other than User Content and third-party material — including the software, design, text, graphics, logos and the Yeeerp name and marks — are owned by Yeeerp or its licensors and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Services for their intended purpose. You may not copy, modify, distribute, sell, lease or create derivative works from any part of the Services without our written permission.
The Services integrate and link to third parties, including mapping providers, sign-in providers, payment and messaging services and the websites of listed businesses. We do not control them, are not responsible for their content or practices, and their own terms and privacy policies apply to your use of them.
The Services are provided “as is” and “as available,” without warranty of any kind. To the fullest extent permitted by law, Yeeerp disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the Services will be uninterrupted, secure or error-free, that defects will be corrected, or that any listing, menu, price, licence status, review or other content is accurate, complete or current. Any reliance you place on that content is at your own risk.
To the fullest extent permitted by law, Yeeerp and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of — or inability to use — the Services, whether based in contract, tort, strict liability or any other theory, and even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the total amount you paid to Yeeerp in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent the law permits, and nothing in these Terms limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless Yeeerp and its officers, directors, employees and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the Services, your User Content, your breach of these Terms, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to any dispute-resolution procedure we agree with you in writing, you and Yeeerp submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of or relating to these Terms or the Services.
Before filing a claim, you agree to contact us at legal@yeeerp.com and attempt to resolve the dispute informally. Nothing here prevents either party from seeking injunctive relief to protect its intellectual property.
We may update these Terms from time to time. When we do, we will revise the “last updated” date at the top of this page, and if the changes are material we will give you additional notice before they take effect. Continuing to use the Services after an update means you accept the revised Terms. If you do not agree to a change, stop using the Services and close your account.
